Concerned about respecting the privacy of Internet users, MYELI undertakes to ensure that the collection and processing of personal information of users and customers of its site myeli.fr (the Site) and the MYELI application are carried out in accordance with EU Regulation No. 2016/679 of the European Parliament and of the Council of April 27, 2016 on the Protection of Individuals with regard to the processing of personal data and on the free movement of such data (hereinafter " GDPR”) and all the provisions of the applicable French regulations in this area.

Personal data means any information relating to a directly or indirectly identified or identifiable natural person (hereinafter the “Data”). The Privacy Policy applies to the Data of the person using the Site and/or the MYELI application (hereinafter the “User”) and who is either:

  1. A MYELI Customer, designating the natural person who has created a Customer account and who has ordered a MYELI jewel in accordance with the MYELI T&Cs; either
  2. A MYELI Prospect, designating the natural person who has subscribed to the MYELI newsletter and/or who has created a Customer account, but who has not yet ordered a MYELI jewel; either
  3. A MYELI Visitor, designating the person browsing the Site under the conditions defined in the MYELI Site T&Cs, without having created a Customer account or having placed an order for MYELI jewellery.

MYELI protects the privacy of Users of the Site and the MYELI application by ensuring the protection, confidentiality, non-alteration, availability and security of the Data entrusted to it on all of its communication channels.

MYELI undertakes to take all necessary measures to:

  1. Provide clear and transparent information on how the Data will be processed;
  2. Put in place all the technical and organizational measures necessary to protect the Data against disclosure, loss, alteration or access by an unauthorized third party;
  3. Keep the Data only for the time necessary for the purposes of the determined processing;
  4. Offer the user the possibility at any time to access and/or modify their Data via their personal account on the Site and/or the MYELI application.

ARTICLE 1 - RESPONSIBLE FOR PROCESSING

MYELI is responsible for processing within the meaning of the GDPR.

MYELI, is the SAS whose head office is located at 381 Boulevard du President Wilson, 33200 Bordeaux, and registered with the RCS of Bordeaux under the number 824 522 809.

ARTICLE 2 - CATEGORIES OF PERSONAL DATA

2.1 Data collected on the Site

On the basis of the User's consent, the Data is necessarily collected, processed and/or stored on the occasion of:

  1. Browsing on the Site which uses cookies;
  2. Subscription to the MYELI newsletter;
  3. The creation and management of a personal account;
  4. The conclusion of an order on the Site by the Customer and its execution;
  5. The production of site traffic statistics.

In general, MYELI collects, stores and/or processes the following Data:

  1. Identification data which corresponds to Data linked either to the filling in of the contact form (first name and e-mail address), or to the creation and management of the Customer's personal account and/or to the conclusion of an order, this is i.e.: title, surname, first name, e-mail address, postal address, telephone number and encrypted password;
  2. Connection data which corresponds to the Data allowing the creation of a history of authenticated accesses on the MYELI server (connection logs) by the User;
  3. Billing data which corresponds to Data related to the Customer's means and payment history, transaction data and invoices;
  4. Commercial data corresponding to the Data necessary for the production of statistics and commercial communications, in particular but not only through the sending of the newsletter to the User who has registered for it.

2.2 Data collected on the MYELI application

The Data collected by MYELI via the application is strictly necessary for the proper functioning of the application and the MYELI jewel.

Only Data related to Customer account information (surname, first name, telephone number, e-mail address), as well as the surnames, first names and telephone details of the Customer's emergency contacts and Home Safe contacts are collected and stored on the MYELI server. .

Other information is collected via the MYELI application, but is not stored there, these are Data related to the collection:

  1. The geolocation of the Customer on the MYELI server when he triggers the alert through his connected jewel;
  2. Calls or text messages sent by the Customer to their emergency contacts and/or Home Safe contacts;
  3. Audio recording triggered during the alert.

2.3 Data collected on the Site and the MYELI application concerning minors

The collection and processing of the Data of the minor User under the age of 16 must be consented to by his legal guardian prior to the communication of Data concerning him.

A User under the age of 18 at the time of the creation of a Customer account has a specific right to the erasure of the Data concerning him.

ARTICLE 3 – PURPOSES OF PERSONAL DATA PROCESSING

The Data is kept for a period in accordance with the legal provisions or proportional to the purposes for which it was collected. This duration varies depending on the type of Data collected and processed.

MYELI uses the Data referred to in Article 2 (Categories of Personal Data) for the following purposes:

3.1 Identification and contact data

MYELI processes this category of Data in order to provide the User with the supply of products and the operation of the services of the Site and/or the MYELI application, with the following sub-purposes:

  1. Managing and updating the User's personal information in a dedicated database;
  2. The processing of requests from the Site's contact form;
  3. Consideration of the Customer's order and its execution;
  4. The transmission of an alert message/call to the Customer's emergency contacts;
  5. Transmission of a reassuring message to the Customer's Home Safe contacts;
  6. The communication of the geolocation of the Customer to his emergency contacts in the event of an alert;
  7. The audio recording triggered by the alert given by the Customer.

This Identification Data is kept for the entire duration of use of the MYELI jewel and the application by the Customer. The Customer's GPS position is only kept for two (2) minutes for the duration of the alert. The audio recording file is kept for a period of one (1) year for the purposes of preservation of evidence.

3.2 Login data

MYELI processes this Data in order to offer the User the most fluid and simple browsing experience possible on the Site and/or the MYELI application, with the following sub-purposes:

  1. The development of attendance statistics;
  2. Security monitoring and rapid recognition of threats in the event of an attack.

These Connection Data are kept for a maximum of twelve (12) months by MYELI.

3.3 Billing and anti-fraud data

MYELI processes this Data in order to recover unpaid bills and to fight against fraud with the following sub-purposes:

  1. Collecting and securing payments;
  2. Billing and collection management;
  3. Fraud detection and prevention.

These banking and invoicing Data are kept by the payment provider of MYELI until full payment by the Customer and, for the purposes of proof in the event of a complaint, for 13 (thirteen) months or 15 (fifteen) months if it is a deferred debit payment card. The cryptogram of the Customer's card is kept only for the time necessary to carry out each transaction.

3.4 Commercial data

MYELI processes this Data in order to carry out commercial operations relating to the products and services sold with the following sub-purposes:

  1. The management of marketing/commercial prospecting actions relating to the use of the Site;
  2. Sending commercial communications relating to MYELI products and services by e-mail;
  3. The development of trade statistics;
  4. Sending information on the modification or development of MYELI products and services;
  5. The creation and management of MYELI Customer and Prospect files.

This Commercial Data is kept for three (3) years from its collection.

ARTICLE 4 – RECIPIENTS OF PERSONAL DATA

MYELI does not share User Data with third parties, except in specific circumstances where it is communicated to the following persons:

  1. To employees of MYELI's internal services in relation to processing: in accordance with regulations, access to Data is based on individual, limited and supervised access authorizations.
  2. To subcontractors or service providers who provide, in particular, on behalf of MYELI:

ARTICLE 5 – TRANSFER OF PERSONAL DATA OUTSIDE THE EU

MYELI stores User Data in the territory of the European Union. However, if it has to transfer the Data to subcontractors or business partners outside the EU, MYELI ensures that the processing is governed by the standard contractual clauses of the European Commission which make it possible to guarantee a sufficient level of protection of life. privacy and fundamental human rights.

ARTICLE 6 – SECURITY OF PERSONAL DATA

As data controller, MYELI takes all necessary measures to preserve the security and confidentiality of the Data and in particular, to prevent it from being damaged, or that unauthorized third parties have access to it. To this end, MYELI makes every effort to guarantee the physical security of the buildings housing its computer systems, as well as the security of its computer system, in particular by providing encryption measures.

MYELI does not provide the Data to third parties, unless it is necessary to complete the service that the Customer has contracted, in particular with any technical subcontractors or in the context of shipping and delivery operations. delivery of the Order. MYELI does not make commercial use of User Data with third parties.

ARTICLE 7 – ACCESS, RECTIFICATION, OPPOSITION AND CANCELLATION

7.1 In accordance with the legal and regulatory provisions of the GDPR, the User has:

  • of a right of questioning ;
  • of a permission to access and of rectification of its Data;
  • of a right to erasure. In the event of a request to delete the Data, MYELI may nevertheless keep them in the form of intermediate archiving, for the duration necessary to meet its legal, accounting and tax obligations;
  • of a right of restriction of the processing of their Data. It is important to note that this right only applies if:
  • The User disputes the accuracy of his Data for the duration allowing him to verify the accuracy of the latter,
  • The User considers that MYELI is unlawfully processing his Data and requires a limitation of their use rather than erasure,
  • MYELI no longer needs the User Data with regard to the purposes referred to in Article 3 but that these are still necessary for the recognition, exercise or defense of the User's rights in court;
  • In the event of exercise of the User's right of opposition during the verification period on the point of knowing whether the legitimate reasons that MYELI pursues prevail over those of the User;
  • of a right to portability of his Data to a certain extent, i.e. the right to receive the Data he has provided to MYELI in a structured, commonly used format and the right to transmit this Data to another data controller;
  • of a right of opposition that the Data concerning him are processed;
  • of a right of opposition that its Data is used for prospecting purposes, in particular commercial. In this respect, the User can unsubscribe from each newsletter he receives, because it contains an unsubscribe link on which he can click to be removed from the MYELI mailing lists;
  • of a right to object to marketing profiling, i.e. the User would continue to receive commercial solicitations but these will be less relevant and will no longer be targeted according to their areas of interest;
  • And a right to define general and/or specific directives relating to the fate of their Data and how the User wishes his rights to be exercised after his death. In this respect, in the event of death which would be brought to the attention of MYELI, the User's Data will be deleted, unless it is necessary to keep them for a determined period for reasons relating to the legal and regulatory obligations of MYELI and/or the deadlines statutes of limitation, and after, where applicable, having been communicated to a third party possibly designated by the User.

MYELI will send a response within a maximum of one (1) month following the date of receipt of the User's request.

ARTICLE 8 – UPDATE OF THE PRIVACY POLICY

This privacy and personal data protection policy may be modified or adjusted at any time by MYELI. The User is invited to consult it regularly.

MyEli sends text messages to its users if they press their connected jewel to alert them to an unsafe situation. Users enter the numbers of their loved ones, to be contacted in the event of danger. If the user triggers their jewel, MyEli sends an SMS & call containing a message recorded by the user, as well as their GPS position (available for 5 minutes only). MyEli can also send a "false alarm" sms to the contact entered by the user. MyEli can also send « home safe" sms to the user's contacts. MyEli does not send any other information by SMS.
